Oceanus Terms of Use

These Terms of Use govern your use of the Oceanus mobile application ("App") developed by LiJordan. By downloading, installing, or using Oceanus, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using Oceanus, you agree to these Terms of Use. If you do not agree, do not use the App.

2. Description of Service

Oceanus is a mobile application that provides:

  • Marine species identification using AI-powered image recognition
  • A comprehensive catalog of marine species with detailed information
  • Personal collection tracking of identified species
  • Detection history, favorites, and dive log management
  • Cloud synchronization when signed in with Google or Apple
  • Integration with Garmin devices to sync dive logs and fishing activity data
  • Visualization of species habitats on maps based on your activity locations
  • Social features: user search, following other users, viewing public profiles, and followers/following lists
  • Optional sharing of your species seen and your dive log on your public profile, with per-user visibility controls
  • Optional push notifications for social events (for example, when someone follows you)

3. User Accounts

  • You may use certain features without creating an account
  • Full features, including cloud sync, social features, and Garmin integration, require signing in with Google or Apple
  • You are responsible for maintaining account security
  • You agree to provide accurate information
  • Your display name, nickname, and profile photo may be visible to other users of the App once you sign in. Do not use personally identifying information in these fields if you prefer to remain anonymous.

4. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Reverse engineer, decompile, or disassemble the App
  • Use the App to harass, stalk, impersonate, threaten, or harm other users
  • Create fake accounts or impersonate other individuals, brands, or public figures in your display name or nickname
  • Upload malicious content or compromise App security
  • Use automated systems or bots to access the App, mass-follow users, or scrape profile data
  • Collect, republish, or redistribute other users' dive log data — in particular dive site names, coordinates, and notes — outside the App
  • Circumvent usage limits or access restrictions
  • Send unsolicited messages, spam, or inauthentic interactions through the follow feature or any social channel

5. Species Identification Disclaimer

Important: The AI-powered species identification is for informational and educational purposes only. Results may not always be accurate.

  • We do not guarantee accuracy, completeness, or reliability of identification results
  • Always exercise caution when interacting with marine life
  • Some species may be dangerous or protected by law
  • Do not use the App as a substitute for professional marine biology expertise
  • Never consume or handle species based solely on App identification

6. Garmin Integration

When you connect your Garmin account:

  • You authorize us to access your diving and fishing activity data
  • Data is used only within Oceanus to display your activity history and link species discoveries
  • You can disconnect Garmin integration at any time in App settings
  • We are not responsible for Garmin service availability or data accuracy
  • Your use of Garmin Connect is subject to Garmin's terms of service

7. Intellectual Property

  • The App, including design, features, content, and code, is owned by LiJordan
  • Species images and descriptions are for personal, non-commercial use only
  • You may not reproduce or distribute App content without permission

8. Subscriptions and Payments

  • Premium features are available through in-app subscriptions
  • Subscriptions are processed through Google Play Billing (Android) and Apple StoreKit (iOS)
  • Terms and pricing are displayed at purchase
  • Manage or cancel subscriptions in your Google Play or Apple Subscription settings
  • Refunds are subject to Google Play's or Apple's policies

9. User-Generated Content and Public Profile

  • Images you capture remain your property
  • You grant us a limited license to process images for identification
  • We do not claim ownership of your images
  • Dive log entries you create, including site names and your written notes, remain your property. We do not claim ownership of them
  • By signing in and using social features, you agree that your public profile information (display name, nickname, profile photo, chosen user type, follower and following counts, and species-seen count) will be visible to other signed-in users of the App
  • Follow relationships you create are stored in our systems and are visible to other users in follower/following lists
  • Your species seen and your dive log may additionally be shown to other users according to the visibility level you choose in Settings → Privacy. Your dive log defaults to being visible to your followers; see the Privacy Policy for what a dive entry contains and how to change or disable this
  • You are responsible for what you publish. Dive site names and dive notes are free text and may be read by other users at the visibility level you have chosen — do not include other people's personal information, and consider whether a dive site's location is sensitive before sharing it

10. Push Notifications

  • Push notifications are optional and require your explicit consent through the system permission prompt
  • You may enable or disable push notifications at any time in your device's Settings
  • We may send you notifications about social events on your account (for example, when someone follows you). We do not use notification tokens for advertising
  • See our Privacy Policy for details about how notification tokens are stored and processed

11. Privacy

Your use of Oceanus is governed by our Privacy Policy. Please review it for details on data collection and use.

12. Limitation of Liability

  • The App is provided "as is" without warranties
  • We are not liable for damages arising from App use
  • We are not responsible for harm from reliance on identification results
  • We are not responsible for injuries during diving or fishing activities
  • Maximum liability is limited to amounts paid for subscriptions in the past 12 months

13. Indemnification

You agree to indemnify LiJordan from claims, damages, or expenses arising from your use of the App or violation of these Terms.

14. Third-Party Services

  • The App integrates with Google, Firebase, Firebase Cloud Messaging (FCM), Apple Push Notification service (APNs), Apple StoreKit, Gemini AI, and Garmin
  • Your use of these services is subject to their respective terms
  • We are not responsible for third-party service availability or content

15. Modifications

We may:

  • Modify, suspend, or discontinue features at any time
  • Update these Terms as needed
  • Change subscription pricing with reasonable notice

16. Termination

  • You may stop using the App by uninstalling it
  • We may terminate access for Terms violations, including abuse of social features (harassment, impersonation, mass automated behavior, etc.)
  • Upon termination, your usage rights cease immediately
  • Request account deletion by contacting us

17. Governing Law

These Terms are governed by the laws of Poland.

18. Severability

If any provision is unenforceable, remaining provisions continue in effect.
